According to the 2018 Farm Bill, the legality of delta-8 depends on where it is obtained from and the delta-9-THC concentration. If d8 comes from Cannabis Sativa, it’s illegal. If it comes from hemp and contains less than 0.3% THC, it is legal federally.

However, the laws are still shifting and confusing almost three years after the 2018 Farm Bill was signed into law. An example is a rule published by the DEA in August 2020.

The laws may also vary between states. Always research the laws in your state before making a purchase.

The safety of your delta-8 product depends on where you get it from. Not all delta-8 is made the same. 

Delta-8 is safe to consume like most hemp products, including CBD. 

Before buying delta-8, ensure the product is tested by a third-party lab and the COAs available. Go through the COAs and check whether it’s tested for heavy metals, microbial, solvents, and farm chemicals residue. A proper lab test will show “ND” for non-detected in those categories.

Always purchase d8 from reputable brands and shops to avoid getting fake or low-quality products that may also be harmful to your health. 

The hemp industry is still not well regulated; thus, the burden of verifying quality and safety falls on the consumer. Ensure you do proper research on the brands you intend to buy, their processes, and consumer feedback.
